fa بررسی چالش‌های حقوقی حکمرانی محلی در ارتقای تاب‌آوری شهری و ارائه راهکارهای اصلاحی در جمهوری اسلامی ایران تخصصي Special پژوهشي Research <span style="font-size:12pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span lang="FA" style="font-size:11.0pt"><span b="" mitra="" style="font-family:">هدف: </span></span></b><span lang="FA" style="font-size:11.0pt"><span b="" mitra="" style="font-family:">با توجه به گسترش مفاهیم حکمرانی نوین و تأکید بر مشارکت مردم، شفافیت و پاسخگویی در سطح محلی، تقویت حکمرانی محلی به یکی از الزامات توسعه پایدار و مردم‌سالاری کارآمد تبدیل شده است. با این حال، در جمهوری اسلامی ایران، ساختار حقوقی و قانونی حاکم بر نهادهای محلی همچنان با چالش‌های بنیادینی مواجه است که مانع از تحقق حکمرانی مطلوب در سطح محلی می‌شود. نبود توازن میان تمرکز و تمرکززدایی، ضعف در قوانین مربوط به شوراهای اسلامی و نهادهای اجرایی محلی و همچنین عدم شفافیت در حدود صلاحیت‌ها از جمله مهم‌ترین این چالش‌هاست.</span></span></span></span></span></span><br> <span style="font-size:12pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span lang="FA" style="font-size:11.0pt"><span b="" mitra="" style="font-family:">روش پژوهش: </span></span></b><span lang="FA" style="font-size:11.0pt"><span b="" mitra="" style="font-family:">این مقاله با استفاده از روش توصیفی-تحلیلی و از طریق بررسی اسناد قانونی، قوانین بالادستی و تحلیل تطبیقی با تجارب برخی کشورها، به واکاوی چالش‌های حقوقی موجود پرداخته و راهکارهایی برای اصلاح و بازنگری ارائه می‌دهد. ابزار اصلی گردآوری اطلاعات، مطالعات کتابخانه‌ای و تحلیل اسناد حقوقی بوده است. <b>یافته‌ها: </b>نتایج تحقیق نشان می‌دهد که اصلاحات در چند سطح کلیدی شامل بازنگری در قانون اساسی، اصلاح قوانین شوراها و تقویت استقلال مالی و اداری نهادهای محلی ضروری است.</span></span></span></span></span></span><br> <span style="font-size:12pt"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span lang="FA" style="font-size:11.0pt"><span b="" mitra="" style="font-family:">نتیجه‌گیری: </span></span></b><span lang="FA" style="font-size:11.0pt"><span b="" mitra="" style="font-family:">ایجاد سازوکارهای حقوقی شفاف برای پاسخگویی و مشارکت عمومی می‌تواند زمینه‌ساز بهبود حکمرانی محلی گردد. در مجموع، تحقق حکمرانی محلی کارآمد در ایران مستلزم اراده سیاسی، اصلاحات حقوقی ساختاری و تقویت ظرفیت‌های نهادی است.</span></span></span></span></span></span><br> &nbsp; <span style="font-size:12pt"><span style="line-height:14.0pt"><span new="" roman="" style="font-family:" times=""><b><span style="font-size:9.0pt">Objective</span></b><span style="font-size:9.0pt">: This study investigates the legal challenges impeding local governance in Iran from enhancing urban resilience. Despite constitutional recognition, local bodies are hampered by a centralized system, legal ambiguity, and a lack of independence. The research aims to systematically analyze these challenges and propose reform solutions to improve the relationship between central and local authorities.</span></span></span></span><br> <span style="font-size:12pt"><span style="line-height:14.0pt"><span new="" roman="" style="font-family:" times=""><b><span style="font-size:9.0pt">Methods</span></b><span style="font-size:9.0pt">: The research employs a descriptive-analytical method, utilizing a review of legal documents and a comparative analysis with international experiences to dissect existing legal issues and propose reforms.</span></span></span></span><br> <span style="font-size:12pt"><span style="line-height:14.0pt"><span new="" roman="" style="font-family:" times=""><b><span style="font-size:9.0pt">Results</span></b> <span style="font-size:9.0pt">The findings reveal a significant gap between the ideals of participatory democracy and good governance, and Iran&#39;s reality. An institutionalist approach shows that while formal structures like councils exist, they are undermined by a weak participation culture, lack of financial and decision-making autonomy, and ineffective accountability mechanisms. This prevents the realization of true democracy and effective local governance, rendering citizen participation merely instrumental.</span></span></span></span><br> <span style="font-size:12pt"><span style="line-height:14.0pt"><span new="" roman="" style="font-family:" times=""><b><span style="font-size:9.0pt">Conclusions</span></b><span style="font-size:9.0pt">: In conclusion, Iran&#39;s local governance is semi-functional and inadequate for crisis management. A multi-level reform agenda is essential, including constitutional revision, a comprehensive local governance law to ensure autonomy, and the creation of sustainable financial resources. Enhancing transparency and institutionalizing citizen participation are also critical.
